1. Introduction
Welcome to Dressie AI, a web-based service that uses artificial intelligence to provide virtual clothing try-on using your photos. These Terms of Service (“Terms”) are a binding agreement between you (the user) and Dressie AI (operated by our company registered in Russia). By accessing or using Dressie AI (including via our website or through platforms like Telegram), you agree to comply with these Terms. If you do not agree, you must not use the Service.

Acceptance of Terms: By using Dressie AI, you confirm that you have read, understood, and accepted these Terms. We may update these Terms from time to time. If we make material changes, we will notify users by updating the “Last Updated” date or through the Service, and your continued use after changes means you accept the revised Terms.

2. Description of the Service
Dressie AI provides a platform for virtual clothes fitting. Users can upload their photos, and our AI will generate images of the user wearing selected garments. The Service is provided via a web interface (and may also be accessible via a Telegram bot or other platforms). The core features include processing your uploaded images to produce virtual try-on results, which are delivered back to you.

Service Availability: We continuously improve the Service and may add, change, or remove features at our discretion. We strive to maintain high availability, but we do not guarantee the Service will be uninterrupted or error-free at all times. We may suspend or limit the Service for maintenance or other reasons to ensure the Service’s integrity.

Personal Use: Dressie AI is provided for your personal, non-commercial use (such as trying on outfits for yourself). Any use of the Service for commercial purposes (for example, using it to advertise products or on behalf of a business) requires our prior written consent.

3. Eligibility and Age Restrictions
You must be an individual at least 18 years old (or the age of legal majority in your jurisdiction) to use Dressie AI. If you are under 18 but at least 13 years old, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Dressie AI is not intended for children under 13, and we do not knowingly solicit or allow use by anyone under 13 (see also the Privacy Policy’s Children’s Privacy section). By using the Service, you represent that you meet these age requirements.

We reserve the right to refuse access to any user or to limit use of the Service if we have reason to believe a user is under the required age or otherwise incapable of entering into a binding agreement. If we previously disabled or terminated your account for violations, you are not permitted to create a new account or use the Service without our express permission.

4. User Accounts and Username
Registration: Registration is optional for using Dressie AI. You may access the core features without creating a traditional account; however, you will be asked to provide a username (or will use an existing identifier, such as your Telegram username, if you are using the Telegram bot). The username is used to identify your orders and allow access to certain features (for example, viewing your generated images or purchase history). No password or additional personal details are required for a basic account in our current model.

Account Responsibility: If you do choose to register or use a username, you agree to provide an accurate and unique username and not to impersonate any other person or entity. You are responsible for all activities that occur under your username. If you suspect any unauthorized use of your username or account, you should notify us immediately. Although our system may not use passwords for basic use, if any authentication token or method is provided to you, keep it secure.

Third-Party Platforms: If you access Dressie AI through a third-party platform like Telegram, your use is also subject to that platform’s terms and policies. For example, if you interact with Dressie AI via a Telegram bot, you must comply with Telegram’s terms of service in addition to our Terms. We are not responsible for the practices of third-party platforms. Your username on such platforms (e.g., your Telegram handle) may serve as your user identifier in our Service.

5. Fees and Payment
Paid Service: Dressie AI operates on a paid model. Certain uses of the Service (such as generating virtual try-on images) require payment. The pricing and payment terms will be disclosed to you before you complete a purchase or request a paid generation. This may include purchasing credits, a subscription plan, or pay-per-image fees, as applicable. By making a payment, you agree to the pricing and billing terms applicable to the Service at the time of purchase.

Payments Processing: Payments are handled through third-party payment processors for security. You may be required to provide customary billing information such as name, billing address, and payment details (e.g., credit card number) to these payment processors. Dressie AI does not store your financial information (such as full credit card numbers) on our servers; that information is provided directly to our payment processors who are obligated to handle your data securely. You must provide valid payment information and by providing it, you represent that you are authorized to use the payment method.

Charges and Taxes: You agree to pay all fees or charges incurred under your account at the rates in effect for the billing period in which such fees and charges are incurred. All payments are due immediately and will be billed to your chosen payment method. Prices are listed in the indicated currency and may not include applicable taxes or duties; if any such taxes apply (for example, VAT or sales tax), they may be added at checkout according to your billing address. You are responsible for any applicable taxes or fees not collected by us.

No Refund Policy: All sales are final. Due to the digital nature of the Service (immediate generation of a personalized digital product), fees for image generations are non-refundable once the process has been initiated and a result delivered. However, if you experience a technical failure or do not receive the service you paid for, please contact us – we may, at our sole discretion, provide a re-generation or credit to your account. We comply with any refund rights that consumers have under applicable law, but in the absence of such requirements, our default policy is no refunds.

Failure to Pay: If your payment method is declined or if your account has an outstanding balance, we may suspend or cancel your access to paid features. You agree to reimburse us for any collection costs (including reasonable attorneys’ fees) if we are required to seek payment of overdue amounts.

6. User Content and Intellectual Property Rights
6.1 Your Content (Photos and Inputs)
When you use Dressie AI, you may upload or provide content, such as your personal photograph and any other data required to generate the virtual try-on (collectively, “User Content”). You retain ownership of your User Content. We do not claim any ownership rights in the photos or other materials you upload. They remain yours.

By uploading or submitting any User Content, you grant Dressie AI a limited, worldwide, non-exclusive, royalty-free license to use, copy, modify, and process your content solely for the purpose of operating the Service and generating the requested outputs. This means we have your permission to temporarily store and process your images through our AI algorithms, and to create derivative images (the virtual try-on results) for your personal use. This license is necessary for us to provide the Service to you – for example, to load your photo into our AI model, apply the outfit onto it, and send you back the composite image. We will not use your photos for any other purpose without your further consent. Specifically, we do not use your personal photos in public marketing materials or share them with third parties except as permitted in these Terms and our Privacy Policy.

No Storage of Images: Dressie AI does not store or retain your photos after processing beyond the immediate needs of the generation process. All image processing is temporary and transient, meaning your uploaded photos are used in memory or temporary storage while the AI processes the image, and then the photos are either deleted or irreversibly anonymized once the output is delivered to you. The resulting generated image may be briefly cached to ensure you receive it, but we do not keep your original, unaltered photos on our servers after the process is complete. Output Results: The images generated by Dressie AI based on your input photo (“Output Images”) are provided to you for your personal use. To the extent the Output Images are derivative works of your original photo, you would retain ownership of those aspects of the output that derive from your photo. We make no claim of ownership over the unique visual results of the AI processing for your personal image. However, note that any clothing designs or other elements used in the virtual try-on may be subject to intellectual property rights of their respective owners (for example, if the Service uses real product images or designs, those remain property of the brand or creator). Dressie AI grants you a personal, non-commercial license to use, save, and share the Output Images for lawful purposes. You may not use the outputs in a way that suggests an endorsement by Dressie AI or to mislead others (for instance, do not use an output image to impersonate someone or commit fraud).

Your Responsibilities for Content: When you upload content to the Service, you affirm that: (a) you either own the rights to the content or have obtained all necessary permissions from the rightful owner to use that content with the Service; and (b) our processing and output generation of that content will not violate any law or infringe any rights of any third party. Do not upload images of anyone other than yourself unless you have that person’s explicit consent. For example, if you upload a photo of a friend or family member, you must have their permission. You are solely responsible for the content you provide and for ensuring it complies with these Terms and all applicable laws. We do not review all user uploads, but we reserve the right to remove or delete any User Content that we deem to violate these Terms or any law.

6.2 Dressie AI Intellectual Property
All rights, titles, and interests in and to the Dressie AI Service (including our website, apps, software, algorithms, models, design, text, graphics, logos, trademarks, and other content provided by us) are owned by Dressie AI or our licensors. The Service is protected by copyright, trademark, and other intellectual property laws. We only grant you a limited, revocable license to access and use the Service for its intended purpose under these Terms. You do not acquire any ownership rights in our intellectual property by using the Service or by purchasing any digital outputs. You may not copy, distribute, modify, publish, or create derivative works from our software, models, or any content on our site that isn’t your own User Content, unless you obtain our prior written consent.

Any feedback, suggestions, or ideas you provide regarding Dressie AI are completely voluntary, and we are free to use them without any obligation or compensation to you. Providing feedback grants us a non-exclusive, perpetual license to implement and use the feedback for any purpose.

7. Acceptable Use Policy: Permitted and Prohibited Uses
We want Dressie AI to be used safely and responsibly. By using the Service, you agree to the following rules:

7.1 Permitted Use:
- Use Dressie AI only for lawful purposes and in accordance with these Terms.
- You may use the Service to upload your own photos (or photos you have permission to use) and to generate virtual try-on images for personal, non-commercial enjoyment, evaluation, or informational purposes (for example, to help you decide on clothing styles or just for fun).
- If you share any Output Images publicly (such as on social media), you should do so responsibly and without violating anyone’s rights or privacy. We recommend you indicate that the image is a simulated “virtual try-on” if there could be any confusion about its authenticity.

7.2 Prohibited Uses: You agree not to engage in any of the following when using Dressie AI:

• Illegal or Harmful Content: Do not upload or share any content that is illegal, defamatory, libelous, obscene, pornographic, indecent, harassing, threatening, or that encourages violence or any illegal activity. This includes content that exploits or harms minors in any way (absolutely no images of minors in sexual or violent contexts) and any content that violates laws or regulations.
• Intellectual Property Infringement: Do not upload images or content that infringes the copyrights, trademarks, privacy, publicity, or other rights of any person or entity. For example, do not use photographs of celebrities or other individuals without permission, and do not use images that you copied from the internet unless you have the right to use them.
• Personal Data and Privacy of Others: Do not upload images that contain sensitive personal data of others (for instance, ID documents, personal information, or someone’s image without consent). Respect privacy rights – you should not attempt to use the Service to create content that would be invasive of another person’s privacy or could be used for identity theft or harassment.
• Malicious Activity: You must not use the Service to transmit viruses, malware, or any other harmful code. Additionally, do not attempt to gain unauthorized access to our systems or other users’ data, and do not attack or disrupt the integrity or performance of our Service (for example, through a denial-of-service attack or any other harmful activities).
• Misuse of Outputs: Do not use the images generated by Dressie AI for fraudulent or misleading purposes. This includes, for example, creating fake images to defame someone, impersonate someone, or to conduct scams. The Service is not to be used to create deepfakes of other individuals without consent. You also should not use the output images in any context that violates any law or regulation.
• Circumventing Restrictions: Do not misuse the Service by attempting to circumvent any usage limits, security mechanisms, or content filtering that we have in place. You agree not to reverse-engineer, decompile, or otherwise attempt to discover the source code or underlying algorithms of the Service. You also agree not to use any automated systems (e.g., bots, scrapers) to access the Service in a manner that sends more requests to our servers than a human can reasonably produce.
• Unauthorized Commercial Use: You may not resell the Service or outputs, or use the Service to provide services to third parties (e.g., offering try-on results to others as part of a business), without our explicit permission. Also, do not use the Dressie AI name, logos, or trademarks without authorization, and do not imply our endorsement of any product or service without permission.

We reserve the right to review, monitor, and/or remove any User Content at our discretion if we suspect it violates these rules. Violation of any of the above may result in suspension or termination of your access (see Section 9 on Termination) and may also expose you to legal liability.

8. Privacy and Data Protection
Your privacy is extremely important to us. By using the Service, you agree that Dressie AI may collect, use, and share your information in accordance with our Privacy Policy (which is incorporated herein by reference). Our Privacy Policy explains what personal data we collect, how we use and safeguard it, and your rights regarding your personal data. Key points include: we only collect minimal personal information (primarily your username and the photos you provide for processing), and we do not retain your photos after processing except in anonymized form or as necessary to provide the Service. We do not sell your personal information to third parties.

Please review our Privacy Policy below to understand how we handle your information. If you do not agree with our data practices as described, do not use the Service. By continuing to use Dressie AI, you acknowledge that you have read our Privacy Policy and consent to the handling of your data as described therein.

9. Disclaimers of Warranties
Dressie AI strives to provide a fun and useful service, but we want to be clear about some important disclaimers. Your use of the Service is at your own risk. The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties and representations, whether express, implied, or statutory, including (but not limited to) any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or usage of trade. We do not warrant that the Service will meet your requirements or expectations, that it will always be available, uninterrupted, secure, or error-free, or that any defects or errors will be corrected.

AI Output and Accuracy: You understand that Dressie AI uses complex AI algorithms to generate virtual try-on images, and the results are simulations. We make no guarantee that the output images will be a perfect or completely accurate representation of how clothing would look or fit in real life. The output is for informational and entertainment purposes. Color, style, and fit in the AI-generated image may differ from reality, and you should not rely on the output as a sole basis for important decisions (such as purchasing clothing) without additional verification. Dressie AI does not guarantee the quality, suitability, or truthfulness of any content generated (for example, if an outfit looks a certain way in the output, we don’t guarantee the actual item will look identical on you).

No Professional Advice: Any information or guidance provided by the Service (for example, styling suggestions) is general in nature. Dressie AI is not a professional fashion consultant or a supplier of the clothes depicted; we are providing an automated simulation. We do not warrant the outcomes of any advice or suggestions given by the Service. You should use your own judgment or consult professionals where appropriate.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, any warranties required by law are limited in duration to 30 days from the first use of the Service or the minimum duration allowed by law.

10. Limitation of Liability
To the maximum extent permitted by applicable law, Dressie AI and its parent company, affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, loss of data, loss of goodwill, or other intangible losses, arising out of or in connection with: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any other user or third party on or via the Service (including any defamatory, offensive, or illegal conduct of other users or third parties); (c) any content obtained from the Service (including outputs); or (d) unauthorized access, use, or alteration of your transmissions or content. This limitation of liability applies whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Dressie AI has been informed of the possibility of such damage.

Maximum Liability: In all cases, Dressie AI’s total aggregate liability arising out of or related to your use of the Service shall be limited to the amount you paid to Dressie AI in the 12 months prior to the event giving rise to the liability (or, if you have not paid Dressie AI for the use of any Service, the sum of USD $50.00). This is the maximum amount for which we are responsible.

Exceptions: Nothing in these Terms shall limit or exclude our liability for gross negligence, willful misconduct, or fraud, or for any other liability that cannot be excluded or limited under applicable law (for example, certain liability under product liability laws or data protection laws may not be excludable). However, in jurisdictions that allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, the above exclusions and limitations shall apply to the fullest extent permitted by law.

You acknowledge that Dressie AI is offered at a reasonable cost (or free in some cases) and that these liability limitations are a fundamental part of the agreement that allow us to offer the Service.

11. Indemnification
You agree to indemnify, defend, and hold harmless Dressie AI, its owning company, affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise out of or relate to: (a) your use or misuse of the Service; (b) your violation of any term of these Terms; (c) your violation of any rights of a third party (for example, infringing someone’s intellectual property or privacy rights by uploading their photo without permission); or (d) any content you upload or submit to the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you (in which case you agree to cooperate with our defense of that claim). This indemnity obligation will survive any termination or expiration of your relationship with Dressie AI and your use of the Service.

12. Termination and Suspension
By You: You may stop using Dressie AI at any time. If you have created an account or username, you can also request that we delete your account or cease storing your username (note that due to the minimal account structure, you might simply discontinue use). Please refer to the Privacy Policy for details on data deletion. If you wish to terminate any subscription or paid use, you may need to cancel the subscription according to the provided instructions; otherwise, it may continue until the end of the billing period.

By Us: We reserve the right to suspend or terminate your access to the Service (or certain features of the Service) at any time, with or without notice, if we believe that: (a) you have violated these Terms or any applicable law; (b) you create risk or possible legal exposure for us (for example, through misuse of the Service); or (c) you haven’t paid fees that are due. We may also suspend the Service or accounts during investigation of suspected misconduct. Where reasonable, we will attempt to notify you of the reason for termination or suspension, but we are not obligated to do so.

Upon termination of your access for any reason, you must cease all use of the Service. Any accrued rights and obligations (including our rights regarding content you’ve already submitted, payment obligations, and indemnification commitments) will survive the termination. Sections relating to Ownership, Disclaimers, Liability, Indemnity, and Governing Law (and any other sections that by their nature should survive) shall survive termination of these Terms.

If your access is terminated and you believe it was in error, or if you wish to request reinstatement, you may contact us to discuss the issue. However, we reserve sole discretion in deciding whether to reinstate a terminated account or user.

13. Governing Law and Dispute Resolution
These Terms and any dispute arising from your use of the Service or relating to these Terms shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law principles. By using the Service, you agree that any disputes or claims arising out of or in connection with this Service will be subject to the exclusive jurisdiction of the courts of Russia, unless otherwise required by applicable consumer protection laws.

If you are a consumer residing outside Russia, you may also be entitled to certain protections or remedies under the laws of your country of residence. These Terms are not intended to limit any such consumer rights that cannot be waived by contract. However, to the extent permitted, any disputes will be resolved under Russian law. We do not submit to the jurisdiction of any other courts or arbitral bodies except as explicitly provided in this section.

International Use: We make no representation that the Service is appropriate or available for use in all locations. If you access Dressie AI from jurisdictions outside Russia, you do so on your own initiative and are responsible for compliance with any local laws. You may not use the Service if it is prohibited by applicable export laws and regulations (for example, if our software is subject to export controls that forbid use in certain countries).

14. Miscellaneous Provisions
Entire Agreement: These Terms (and any additional terms provided when you engage with a particular feature of the Service), along with our Privacy Policy, constitute the entire agreement between you and Dressie AI regarding the Service. They supersede all prior understandings or agreements (whether oral or written) regarding the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by our authorized representative.

Assignment: You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. We may freely assign these Terms as part of a merger, acquisition, sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

No Third-Party Beneficiaries: These Terms do not confer any third-party beneficiary rights. No person other than the parties to these Terms (you and us) shall have the right to enforce any provision of these Terms.

Force Majeure: Dressie AI will not be liable for any delay or failure to perform as required by these Terms because of any cause or condition beyond our reasonable control (such as natural disasters, acts of government, war, civil unrest, strikes, Internet disturbances, or other force majeure events).
